ABSTRACT
Whereas the common law favoured joint tenancies, equity has always leaned in favour of tenancies in common, as equity ‘preferred the certainty and equality of a tenancy in common to the element of chance which the ius accrescendi of a joint tenancy introduced’.7 Consequently, in the following four instances, equity presumes that a tenancy in common has been created.
