Where the title to the land being sold is registered, the requirements up to and including the contract stage are the same as for unregistered land, but the investigation of the title is radically different. In registered conveyancing, the vendor does not need to, and indeed is not entitled to, trace the history of the transactions dealing with the property, since the Register is conclusive evidence of the estate owner’s title. The Register, which is a public document, contains all the information which would be found in title deeds under the unregistered system, such as the owner’s name, a description of the property and the estate held by the owner. Incumbrances, such as mortgages, easements and restrictive covenants, are usually noted on the Register.
