ABSTRACT

In this chapter we consider compensation for dismissal. Other forms of compensation which might be payable (such as for discrimination) are discussed later.

If you wrongfully dismissed an employee you would be required to compensate them for the pay and other benefits they would have received under the contract during the notice period. The employee does not get non-contractual or discretionary benefits. In other words, they have the right to what the contract says they are entitled to, and nothing more. This provision works during the first 12 months of continuous employment.
