If you refuse to grant your employee a right to which they are entitled, they can then complain to an employment tribunal. Section 48 and other subsequent sections of the Employment Rights Act (ERA) 1996 (depending upon the precise nature of the right that has been infringed) give them the right to complain. The tribunal will, if it finds their complaint well-founded, make a statement of their rights (called a declaration) and will award them compensation for any losses they have suffered.
