ABSTRACT

The court will now – provided you got your form-filling right – issue your claim form (put an official stamp on it) and serve it on the debtor.

Service The court normally posts the issued claim form to the defendant. At the same time, the court sends you a form called Notice of Issue (Specified Amount) and Request for Judgment (see ‘Getting a default judgment’, p 38). You cannot get this form from the Court Service website. The form tells you the date of service, that is, the date on which, according to the court rules, the debtor is deemed to have received the claim form. According to the court, first-class post takes two days. If the court posts the claim form, the date of service is two days after posting.
