ABSTRACT

This is the first and most obvious manifestation of the equal pay principle. It is also the most limited in its scope and impact. Unsurprisingly, there were, in the years immediately after the Act took effect, many cases under this section, as employers came to terms with the fact that they were no longer permitted to have separate men’s rates and women’s rates for people doing the same work. One response was to move either women or men to ensure that the like work provision could not be applied.60
