ABSTRACT

The principles of natural justice – they are principles rather than rules, since their application varies according to circumstances – are traditionally expressed in the form of two Latin maxims. Audi alteram partem translates as ‘Hear the other side’, but essentially requires that a person affected by a decision must have a proper opportunity to put his case. Nemo judex in sua causa potest means literally, ‘No man shall be judge in his own cause’, but acts as a requirement that not only must there be an absence of actual bias in decision making, but there must be an absence of an appearance of bias.
