ABSTRACT

Facts In the early hours of the morning, police constables were patrolling an area of Grimsby in which a number of burglaries had taken place earlier that night. The officers saw the appellant behaving suspiciously and asked him where he was going, where he was coming from, and his name and address. The appellant gave only partial (although accurate) details and refused to provide more information. When he refused to accompany the constables to a police box to confirm his identity, he was then arrested on the grounds that he had wilfully obstructed a police constable in the exercise of his duty. The appellant was convicted and appealed to the Divisional Court.
