ABSTRACT

The law relating to freedom of expression is essentially the other side of the same coin as that of privacy and confidentiality. A major difficulty concerns the proper balance to be struck between freedom of expression on the one hand and confidentiality on the other, along with the weight to be given to such public interests as the protection and detection of crime and the proper administration of justice. Much case law concerns the freedom of the press to publish confidential information and information which may have been acquired by unlawful means.
