Obtain a full and detailed description of the driver, together with the originals or copies of any documents that he produced, and pieces of paper on which he wrote down any details, during the first interview and put all the information into a statement to be signed by your client. If there is any doubt about the identity of a driver, the MIB will attempt to have the claim dealt with under the terms of the Untraced Drivers Agreement, thereby avoiding the need for them to pay your reasonable costs. Thus, it is essential to have as much information as possible at the beginning of the claim, in order that you can prove, on the balance of probabilities, that you have identified the driver and the claim should be dealt with as an uninsured and not an untraced one.1
