ABSTRACT

Correspondence between the client (and anyone acting on his behalf)12 and the driver (and anyone acting on his behalf)13 must be served with notice of the issue of proceedings to amount to ‘Proper Notice’,14 and should be obtained immediately to ensure it is not missed at a later date, which may allow the MIB to avoid paying compensation. The client must be warned that the duty continues, as with all disclosure, and therefore if correspondence is subsequently received, he must forward it to you (see 4.3, letter L2).
