ABSTRACT

The MIB excludes claims where the vehicle is a Crown vehicle unless the vehicle is insured. Other vehicles are also excluded from claims against the MIB and are summarised in the checklist at 2.7.

This exempts the MIB from having to satisfy judgments when the claim arises out of the use of a vehicle which is not required to be covered by insurance – the ‘off-road’ exception. Prior to 3 April 2000, vehicles only required insurance when they were being used on a public road and, therefore, accidents off public roads would not lead to any liability on the MIB to satisfy the judgment.11
