ABSTRACT

Re H (A Minor) (Section 37 Direction) (1993) A lesbian couple requested a residence order in relation to a child who had lived with them in their home since being born there.

Held: the situation would be regularised as far as was possible by the grant of interim supervision and interim residence orders. The local authority was directed, under s 37(1) to make an investigation of the child’s circumstances. The phrase ‘child’s circumstances’ should be construed in a wide sense so as to include any situation which might affect the possibility of the child’s being likely to suffer any significant harm in the future.
