Held: the appeal would be allowed. It ought not to be supposed that care proceedings would be adjourned whenever a parent was the defendant in criminal proceedings. Each case would be considered on its specific set of facts and the welfare of the child would be considered as more important than any disadvantage suffered by a defendant in such proceedings. It was essential that the children be settled as soon as possible. The care proceedings would be reinstated swiftly.
