ABSTRACT
The preamble to the CUA 1601 refers to ‘the relief of aged, impotent and poor people’. This has been construed disjunctively so that a trust will be charitable if its beneficiaries are poor but not aged or sick (see Rowntree Housing Association v AG (1983)).
