Where the parties expressly provide for the frustrating event

Generally speaking, if there is an express clause in the contract which covers the occurrence of a certain event, frustration cannot be pleaded when that event happens. However, it may be that the event is more extreme in form than was envisaged by the contract. In such a case, the contract may be frustrated despite an express term in the contract to the contrary.
