ABSTRACT

We have seen that if a seller misdescribes goods he may be liable in one of several ways. He may be liable under s 13 of the Sale of Goods Act; he may be liable for breach of an express term; he may be liable for misrepresentation. Each of these three may entitle the innocent party to recover damages and/or to rescind the contract as against the guilty party.
