ABSTRACT
Since Esterhuizen v Allied Dunbar plc (1998) The Times, 10 June, the solicitor has a heavy burden of duty to see the will is formally executed if he is to avoid a claim for negligence. Normally, he should be present when the will is executed rather than post the will to the testator.
