ABSTRACT

Mrs Maria Teresa Soldani was an assistant psychologist at the co-ordination bureau of the National Centre for the Prevention of Accidents. On 11 February 1983 she applied to the Lazio Regional Administrative Court for judicial review of five decisions in which the Treasury had refused to appoint her to a post in a higher category than the one she held, although she had been in second or third place on the reserve lists published each time such posts had fallen vacant. In a judgment of 17 June 1987 the Administrative Court allowed her application. The Treasury appealed to the Consiglio di Stato. In a judgment of 30 March 1993, the text of which was deposited with the registry on 12 May 1993, the Consiglio di Stato dismissed the appeal as being ill-founded. She complained of the length of proceedings. Comm found by majority (23-6) V 6.
