ABSTRACT

The next two chapters consider the type of sanctions that ought to be imposed if a utilitarian theory of punishment is adopted. The discussion commences by considering the appropriateness of some existing sanctions and, in this respect, the focus is primarily on suspended sentences and preventive sentences. It is suggested that the type of analysis and methodology adopted in this chapter can be used to assess the appropriateness of many other types of criminal sanction.
