ABSTRACT
This chapter continues looking at the practical implications of adopting a utilitarian theory of punishment. The discussion moves from focusing on the type of sanctions which ought to be imposed to a consideration of the reasons and factors that are properly relevant to the determination of how much to punish. This chapter focuses on the sentencing consideration which traditionally weighs heaviest on the minds of sentencers: previous convictions.
