ABSTRACT

The commonest method is for a treaty to come to an end is as provided by the treaty itself. Examples would be where the treaty is for a particular period,102 or where there is a specific minimum period before the option to withdraw arises or where there is a right to withdraw at any time or where the treaty is to endure until a particular project has been accomplished. This practice has been recognised by the Vienna Convention (1969) which provides in Art 54(1)(a) that a state party may withdraw ‘in conformity with the provisions of the treaty’. However, a treaty may also come to an end by agreement and Art 54(1)(b) provides that it may do so ‘at any time by consent of all the parties after consultation with the other contracting states’.
