ABSTRACT

As examined earlier, the parties are given a wide range of discretion, not only to create an express warranty on any point, but also to determine its extent. Simply for this reason, an attempt to describe all different types of express warranties which can be employed in a marine policy is a futile exercise. It is, however, possible to examine the main express warranties, which are used in the market, and the ones which have been specially mentioned in the MIA 1906 – namely, warranty of good safety, nationality and neutrality – for the purpose of illustration.
