ABSTRACT

Hunter v Mann (1974) A police officer, acting under s 168(2)(b) of the Road Traffic Act 1972, asked the defendant for information which might have resulted in the identification of a person suspected of dangerous driving in a stolen car. The defendant was a doctor who had obtained the information solely by virtue of his professional relationship with the suspect. He refused to divulge the information on the grounds that it would be a breach of professional confidence. He was convicted in the Magistrates Court and appealed.
