ABSTRACT
This Act covers dark smoke controls to all trade and industrial premises, and not just chimneys. It includes: chimneys (s 14);161 furnaces (s 1); railway locomotives (s 43); vessels in harbour (s 44); and smoke from trade premises (s 2). There are certain exemptions under the Act, as well as time limits. There are also defences of lighting of a coal furnace; mechanical failure; unavoidable use of unsuitable fuel; and any combination of the above. There is also a defence if there is an inadvertent release and the operator took all practicable steps to avert it. The Act also introduced smoke control areas and standards for chimney heights under s 18.
