ABSTRACT

In the Badgers Act 1992, it is an offence under s 1 to take, injure or kill badgers. Section 1(1) states that a person is guilty of an offence if, except as permitted by or under this Act, he wilfully kills, injures or takes, or attempts to kill, injure or take, a badger. Section 3 covers possession of any dead badger or any part of, or anything derived from, a dead badger. The defences are contained in s 4. Section 3 also concerns interfering with badger setts by damaging all or part of a sett; destroying a sett; obstructing access to, or any entrance of, a badger sett; causing a dog to enter a badger sett; disturbing a badger when it is occupying a badger sett; and intending to do any of those things or being reckless as to whether one’s actions would have any of those consequences.
