ABSTRACT

As we have already mentioned, law and justice are closely associated, but by no means identical. We need now to consider some of the theories which have been constructed to explain this concept and its relationship with law and other social phenomena. We have already stated that justice can be used as a measure of the quality or fairness of the processes of the legal system and of substantive legal rules. Another way of making this distinction is between formal or procedural justice on the one hand and substantial justice on the other. We will consider each in turn.
