The relationship between the EC and the Convention in the protection of fundamental human rights

As we have noted when considering the application of the European Convention on Human Rights, the Human Rights Act 1998 will allow individuals who are victims of public authorities to seek direct redress in the UK courts. Action may also be taken in respect of violations of the Convention by individuals, where the common law fails to protect Convention rights.
