ABSTRACT

It was held in Wheeler v New Merton Board Mills Ltd (1933) that volenti non fit injuria is not a defence to an action brought by an employee for breach of a statutory duty by an employer. Wheeler was approved by the House of Lords in Imperial Chemical Industries Ltd v Shatwell (1965) but it added that the defence of volenti should be available where the employer had not himself or vicariously breached the statutory duty.
