ABSTRACT

Section 9 deals with transfer of authorisations. Authorisations may be transferred to any person who proposes to carry out the process in the ‘holder’s place’. Consent for the transfer is not needed, although the enforcing authority must be notified in writing within 21 days of the transfer. Although in granting an authorisation the authority must have regard to the capability of the applicant (s 6(4)) the authority has no specific power to object to a transfer. But if the authority has serious doubts about the ability or intentions of the transferee to comply with the conditions of the authorisation, there is power to serve an enforcement notice (s 13), a prohibition notice (s 14) or to revoke the authorisation (s 12).
