ABSTRACT

In the light of the above, the 1994 Directive has two main objectives (Art 1): (1) to prevent the production of packaging waste and ensure its reuse and recycling so as to reduce the final amount requiring disposal; and (2) to ensure the functioning of the internal market by avoiding obstacles to trade. The Directive applies to all products used to contain, protect, handle, deliver and present goods which are classed under three headings: (a) primary packaging – usually acquired by the purchaser; (b) secondary packaging – usually removed by the retailer near the point of sale; and (c) tertiary packaging – designed to facilitate handling or transportation (Art 3). Note, that on 7 October 1998 the Commission notified a reasoned opinion against Denmark saying that its ban does not comply with the Packaging Waste Directive.
