ABSTRACT

The meeting of creditors can decide to establish a committee ‘to assist the receiver’. The committee can require the receiver to attend meetings and to provide it with information (s 49). The court can dispense with the meeting under s 48 but creditors must be told of the receiver’s application for dispensation (r 3.8). The rules governing the conduct of the creditors’ meeting in a receivership are contained in rr 3.9-3.15. The functions of the creditors’ committee are to assist the receiver and to act as agreed with him (r 3.18). The usual rules as to meetings of the committee and resolutions passed by it apply.
