ABSTRACT

The procedure for the compulsory acquisition of land is undertaken by the issuing of an order (s 226(7)) which may be the subject of an appeal to the Secretary of State. Any such appeal will be conducted in accordance with the Compulsory Purchase by Non-Ministerial Acquiring Authorities (Inquiries Procedure) Rules 1990, which follow the lines set out in planning appeals (see Chapter 16, para 16.4). Compulsory purchase also includes the power to acquire an easement or other right over land (s 228).
