ABSTRACT

The Planning and Compensation Act 1991 (s 31) repealed compensation restrictions on new development and for restrictions on Sched 3 development, leaving Parts I and III in operation.

Part I, for which no compensation is payable, relates to: 1 the rebuilding of properties in existence on the appointed day (1 July

1948) or any building before that date which was destroyed or demolished after 7 January 1937, including the making good of war damage;

2 the carrying out of maintenance, improvement or other alteration of any building which affects only the interior of the building, and are works for making good war damage so long as the cubic content of the original building is not substantially exceeded; and

3 the use of two or more separate dwelling houses of any building which, at the material date, was used as a single dwelling.
