ABSTRACT

The inspector may make an unaccompanied inspection of the site but is not allowed to enter the site which constitutes private property. Viewing of the site is, therefore, restricted to any vantage point to which the general public have access. The inspection may take place before or during the inquiry without giving notice to the parties at the inquiry. The inspector may also inspect the site after the closing of the inquiry, and must do so if requested by the appellant or the local planning authority during the inquiry. On such occasions, the inspector will be allowed to enter the site if accompanied by the owner or a person with a legal interest in the land.
