Ltd [1981] Ch 105 is overruled. Another possible justification is by analogy to the trust that may arise where money filched from the claimant is used by the defendant to buy an asset for himself: cf El Ajou v Dollar Land plc [1993] 3 All ER 717, p 734 (Millett J).
