ABSTRACT

The judge has the power to waive most defects in the application, if minor. If the judge refuses to exercise his or her discretion, or it would be inappropriate to waive the defect, the advocate can ask for another hearing date allowing time to correct the defect. In some urgent cases, the judge may be persuaded to direct that the case be listed very quickly. You may need to ask for a continuation of the undertaking or injunction, if either is about to expire.
