ABSTRACT

You must not connive in presenting an untrue account to the court. You have a duty not to mislead the court and the client has a continuing duty of full and frank disclosure. Moreover, if the untruth is discovered, your client’s credibility will fall apart. In the case of a small discrepancy, have your client make the alteration themselves and show a copy of the altered version to the other side. If the document is an Form E, the corrected version must forthwith be re-sworn (ask at the court office). You will have to explain this turn of events to the court or your opponent as best you can. If there is not time to do this, deal with it in examinationin-chief.
