ABSTRACT

The Health and Safety Commission’s (HSC) response was Review of Health and Safety Regulation – Main Report published in May 1994. This Review, though now some years old, remains a mine of valuable information about the regulatory system and its operation and will be drawn upon heavily in this and the following chapters. For immediate purposes it is useful to look to p 3, where the Commission summarised its proposals and recommendations:

The overall ‘architecture’ of regulation

1 The Review found widespread support for maintaining the overall architecture of regulation suggested by the Robens Committee and reflected in the Health and Safety at Work etc Act 1974 (HSW Act). Moreover:

(a) even though the current structure had its imperfections, there was concern about the disruption and costs of further major upheaval.
