ABSTRACT

Ted Greeno: My greatest concern about CMCs is that they require a considerable amount of preparation which turns out to be unnecessary. This is a result of case management, and the judge being free to make orders of his own motion... A further aspect of this problem is that it cuts across the principle that a party should know in advance the case he has to meet.
