Raffles v Wichelhaus and Another (1864) CE The parties agreed that the defendants would buy from the plaintiff 125 bales of cotton ‘to arrive ex Peerless from Bombay’. The defendants were expecting the goods to arrive on a vessel named Peerless which was sailing from Bombay in October, but the plaintiff was referring to another ship which was also called Peerless expected to sail from Bombay in December.
