ABSTRACT

This part contains four related chapters, the common element of which is shipowning. Chapter 8 deals with registration of ships and significance of Flag States in the context of a regulatory regime, ownership principles and management of ships. It also explores the legal implications of the International Safety Management Code in liabilities of shipowners, managers and officers, including criminal liabilities. These are discussed in the context of the new regulatory regime imposed by the International Convention for Safety of Life at Sea (SOLAS) 1974, Chapter IX, concerning the enforcement of a safe management and transparent system of ship operations. Chapter 9 highlights important issues of the law relating to ship mortgages, which is an essential part of shipowning. Chapter 10 deals with general legal principles of shipbuilding and Chapter 11 with some aspects of the law relating to ship sale and purchase.
