ABSTRACT
The defendant can escape liability if he has acted in accordance with the Bolam modified test. In prescribing drugs a doctor has a duty to pay heed to any instructions given by the manufacturer; the latter will not normally be liable if the drugs have been provided with a written warning: that will discharge his liability.
