Held: the subject of the programme was in the public interest and the action failed. It was also held that the American Cyanamid principle was not of universal application and in this instance Kerr LJ said (at p 536):
… I do not think that it makes any difference whether this case is decided in accordance with the Cyanamid test or not. On either basis the answer is the same.
