ABSTRACT
The court attempts to provide a home for both parties from the assets to be divided, although pursuant to s 25(1) their first priority will be the welfare of the children of the family, which means a secure roof over their heads and sufficient income to live on during their minority. Sometimes a home for the non-custodial spouse cannot be provided.
