ABSTRACT

In this chapter, only a brief commentary on some of the most important parts of a business lease is provided, but no attempt is made, for reasons of space, to provide a comprehensive list. Such precedents can be found in Aldridge, T, Practical Lease Precedents, London: Sweet & Maxwell. There is a danger that ‘precedents stored electronically … [may] accumulate further provisions over the years, rather like barnacles on the hull of a man-of-war’ (Tromans, S, Commercial Leases, 2nd edition, 1996, p 4). Thus, a provision which is entirely appropriate when added in the context of a particular transaction should not necessarily always be applied thereafter.
