ABSTRACT

In summary trials, the defence has no statutory right to advance disclosure of the evidence and other material on which the prosecution intends to rely at trial: see R v Stratford Justices ex p Imbert [1999] All ER

(D) 115. However, the Attorney General’s Guidelines on Disclosure, issued in November 2000, advise that the prosecutor should, in addition to complying with the obligations under the Criminal Procedure and Investigations Act 1996, provide the defence with all the evidence upon which the Crown intends to rely at summary trial.
