ABSTRACT
The presumption of doli incapax relating to offenders aged 10-13 was abolished by the Crime and Disorder Act 1998, although when representing a juvenile it is still possible to argue lack of mens rea. This chapter also identifies some relevant issues relating to the sentencing of offenders aged 18-20 years.
