ABSTRACT

A system of fees payable in respect of various types of application under the town and country planning legislation was introduced by s 87 of the Local Government, Planning and Land Act 1980. The details of the fees which are to be paid and the legal structure of the fees regime are contained in the Town and Country Planning (Fees for Applications and Deemed Applications) Regulations 1989 SI 1989/193, as amended by SIs 1990/2473, 1991/2735, 1992/1817, 1992/3052, 1993/317 and 1997/37. Following the consolidation of the town and country planning legislation in 1990, instruments regulating planning fees are now made under s 303 of the Town and Country Planning Act 1990 (the ‘1990 Act’). The most recent of these instruments contains the current scale of fees. In this chapter references to ‘the Regulations’ mean the 1989 Regulations, as amended.
