ABSTRACT

It is too easy, particularly in the county court, simply to instruct the Court Bailiff to attend to seize goods without giving detailed thought to the actual situation that exists.

A county court Bailiff will handle more warrants of execution per day than a High Court Sheriff. Although the Review Body on Civil Justice (Cmnd 394, which was the catalyst for the Courts and Legal Services Act 1990) indicated that a recovery rate for both Bailiffs and Sheriffs was broadly the same, most practitioners would question this, believing that using the Sheriff is a more effective means of recovering money than using the county court Bailiff.
